Falcon question (Civil War and House of M SPOILERS)

After reading CW#2 and seeing Falcon backing Captain America up, two questions occured to me.

1) Falcon's identity is already publically known, is it not?
2) Is Falcon one of the 198 mutants left? Or is he powerless now?

Yes he was. Professor X theorized that the cosmic cube unlocked a surpressed mutant gene, therby enhancing the psychic link Falcon had with Redwing.

He was enough of a mutant to be detectable by Sentinels scanning for mutant activity.
