I think Brian believes that if de jure Jim Crow was struck down, then de facto Jim Crow would have followed soon after.

In other words, he thinks there was no reason to make discrimination illegal for private businesses since they were only discriminating because Jim Crow made them do it and without those state laws on the books, they would have been happy to welcome people of any color into their establishments with open arms. Because we know that people never, ever discriminate unless the government makes them.

Reading through it again, there's no point in mentioning anything other than an employee misinterpreted rules and overstepped his/her job. Government is faultless in this.
