View Full Version : I have to fire someone today (sexually harassed and assaulted)

So I'm a student manager at one of the local dining commons on campus. It one of the two jobs I hold down (as well as the library). Today, I'm managing for the first time this semester and this girl who has been notorious for being disruptive and having a "diva-esque" attitude came to work an hour late.
Now, if one arrives to work more than twenty-nine minutes tardy, then it's considered an unexcused absence. I come to her and politely ask her to follow me to the back office (for discussing matters of write-ups and disciplinary action in front of peers and customers is wildly inappropriate and unprofessional). She refuses and announced, rather loudly "I know what you're going to do, and if you have something to say, you can say it in front of my friends (her "posse" also work the produce/deli station)."
I try to be diplomatic and state that, if she comes with me, we might be able to work our way around a write-up and go to a verbal warning and discussion. She refuses. Also of note: I didn't become a student manager until late spring semester, meaning I worked almost two years at the dining commons as a regular student employee. Moreover, I had worked with our "diva" on a regular station as peers for almost a year, and she, as many do when one gains the SM position, resents having to listen to me in a directorial position.
She begins to shout that "you ain't shit, I worked with you before and a name tag and a tie mean nothing." I, again trying to keep my cool, ask her gently to discuss how I could have handled this more appropriately with me in the back office. She again refuses and then says "I heard you suck dick. Why should I have to be told what to do by a fag?!!"
I'm floored. I've never seen much homophobia on campus before. We're all reasonably educated, liberal, and enlightened people. As enraged and hurt that she would say such a hateful thing, I told her that she just engaged in a rather distressing sexual slur against me, which could lead to her immediate termination (which isn't a lie, because I could have fired her on the spot at that moment, save for about half an hour of paperwork) but, again in the name of diplomacy (and not wanting to fire anyone on the first day back and only my fourth shift as a student manager overall), I again tried to get her to escort me to the back office for the initial write-up. Her retort was "I'll just say you called me a [n word...she's black]."
I was immediately frightened about the situation, and customers were gathering around the produce/deli station to witness the drama firsthand. "I'm going to have to report this to Jami [my director] and she won't believe I was acting racist." So diva eventually complies and follows me to the office. She tears up the "write up" sheet she was intended to sign. I hand her over to Jen and explain what happened. I then was to leave the room so "diva" could express her side without my interference to Jami.
I come back ten minutes later to discuss this with Jami only. I'm somewhat nervous when I enter and see Jami laughing. "Yeah, so she tried to say you sexually harassed her and made advances toward her." Jami obviously knows I'm gay. My fearless director proceeded to exclaim that "I take your word for and she's to be terminated."
So I have to go back to the station, get "diva" and take her back to the conference rooms past the kitchen and back office. I sit her down and explain to her everything and why she's being let go. Her response? She punches me in the FUCKING FACE and storms off yelling "fuck this place, fuck that fag" at the top of her lungs repeatedly as she exits the facility.

you could probably get her on a hate crime, if you wanted to. between her punching you and repeatedly calling you a fag, you'd have a pretty good case.

Actually, very smooth. A lot of patrons/students go home for the extended labor day weekend, so it was quite desolate and relaxing.

Ironically, she's called me an "STD Monster" for being gay when we used to work together (found that out later when a fellow student told me what she would say behind my back). I don't get this kind of person.
Somehow, I had already assumed that.
I don't want to come across as hateful or un-PC, but she was the most stereotypical person I've ever met.

Well, I'm currently attending college in Michigan, Mount Pleasant to be exact. It's a small little community around the northern regions of the state and surrounded by small, rural towns that are notorious for their rather conservative and extremely racist perspective. It usually doesn't filter into the campus, but apparently, it has.

How do I file assualt charges? Jami (my director) had me fill out an accident release form excusing the college of any ability to sue (not that I'd want to) and I was to report to a clinic on the commons dollar (nothing's broken, just a swollen jaw that hurts tremendously).
Jami strongly suggested I visit the campus police office and file charges, but it just seems so harsh considering I'll never see her again. I'm conflicted. I really don't want her arrested over this. I'd much rather she find some sort of understanding and tolerance, but I know this will not happen.

You should have been on the phone to your campus police department before this hag even left the building. Now you may have to explain why you waited. DON'T BE CONFLICTED. SHE HAS TO TAKE RESPONSIBILITY FOR HER ACTIONS. Some people have to hit rock bottom before they wake up to reality, and she is obviously one of those people. Please, go to the campus police office, before your swelling goes down, so they can take a picture of you and include it with the police report. Power down your computer, pick up your keys and GO NOW.

I've been raised by homophobic foster parents and brought up in a high school that hated the idea of being "gay." You either wallow in hate or adjust and become forgiving. I chose the later.

Oh, we took some time-stamped Polaroids at work that I have with me. We needed some for the accident report. Jami insisted I take a few with me to show to the police.

I wouldn't assume that. It sounds like she's just "ghetto" enough to come back and try to do something. And if not with you then to someone else.

Follow everyone else's advice, file charges, and then, if you want, once she has it explained to her exactly what "felony hate crime" means, and she starts to think just how tough she'll be in women's prison, THEN, if you want, you can drop the charges or try to work out some sort of deal with the officials. But you need to make the homophobic bitch squirm.

She could easily follow you home from your work. And if she has any friends on the staff of the dining hall, do those people know where you live? And, I don't want to discourage you from pressing charges, but if she's smart she can get a copy of the police report and will have access to any information on it. But she's probably not bright enough to figure that out.

i get that. in my experience though, cops only make things worse in cases like this. with the incident on file with his job, it means it's on file with the college, which means it's going to follow her for her entire time there. she'll never get another college affliated job again, among other things.

I can see how she might be out to get him, but I dont think Todd or anyone else should give a shit if she can or cannot get another job at the college. No one is stopping her from working at the mall or another business.

I don't know, I truly feel that if you're a bit more "liberal and enlightened," you have no problem wiht homosexuality. I don't think me being gay was the issue though. She doesn't like being corrected or told what to do. Simple. So you're right, in that sense.

So I'm a student manager at one of the local dining commons on campus. It one of the two jobs I hold down (as well as the library). Today, I'm managing for the first time this semester and this girl who has been notorious for being disruptive and having a "diva-esque" attitude came to work an hour late.
Now, if one arrives to work more than twenty-nine minutes tardy, then it's considered an unexcused absence. I come to her and politely ask her to follow me to the back office (for discussing matters of write-ups and disciplinary action in front of peers and customers is wildly inappropriate and unprofessional). She refuses and announced, rather loudly "I know what you're going to do, and if you have something to say, you can say it in front of my friends (her "posse" also work the produce/deli station)."
I try to be diplomatic and state that, if she comes with me, we might be able to work our way around a write-up and go to a verbal warning and discussion. She refuses. Also of note: I didn't become a student manager until late spring semester, meaning I worked almost two years at the dining commons as a regular student employee. Moreover, I had worked with our "diva" on a regular station as peers for almost a year, and she, as many do when one gains the SM position, resents having to listen to me in a directorial position.
She begins to shout that "you ain't shit, I worked with you before and a name tag and a tie mean nothing." I, again trying to keep my cool, ask her gently to discuss how I could have handled this more appropriately with me in the back office. She again refuses and then says "I heard you suck dick. Why should I have to be told what to do by a fag?!!"
I'm floored. I've never seen much homophobia on campus before. We're all reasonably educated, liberal, and enlightened people. As enraged and hurt that she would say such a hateful thing, I told her that she just engaged in a rather distressing sexual slur against me, which could lead to her immediate termination (which isn't a lie, because I could have fired her on the spot at that moment, save for about half an hour of paperwork) but, again in the name of diplomacy (and not wanting to fire anyone on the first day back and only my fourth shift as a student manager overall), I again tried to get her to escort me to the back office for the initial write-up. Her retort was "I'll just say you called me a [n word...she's black]."
I was immediately frightened about the situation, and customers were gathering around the produce/deli station to witness the drama firsthand. "I'm going to have to report this to Jami [my director] and she won't believe I was acting racist." So diva eventually complies and follows me to the office. She tears up the "write up" sheet she was intended to sign. I hand her over to Jen and explain what happened. I then was to leave the room so "diva" could express her side without my interference to Jami.

i get that. in my experience though, cops only make things worse in cases like this. with the incident on file with his job, it means it's on file with the college, which means it's going to follow her for her entire time there. she'll never get another college affliated job again, among other things.
And this is a bad thing...why? She fucked up, she gets to live with the consequences. If the worst that happens to her is that she never gets another college affiliated job, then she is getting off lucky.
I understand the perspective of taking the high road and being the bigger person...but this woman committed assault. She cannot simply be allowed to walk away from that without consequences--if for no other reason that it will simply encourage her to continue to act that way in the future, and the next person she attacks may get more seriously hurt (or not be as kind-hearted as Todd, and end up turning it into an all-out brawl).
Honestly, I think it would be a bit irresponsible to not file charges and let her think she can go around punching people whenever she wants.

I'm rather conflicted, as I do appreciate the need to not allow this girl the notion she can do whatever she likes to whoever she likes around campus and anywhere else. She's socially unacceptable. However, I also know that nothing came of it, and I don't want this black cloud on her record haunting her.
I went to the station and, because of the unique circumstances and structure of a campus police department, I was given a few options: firstly, I gave my work's accident report, the walk-in clinic report, the pictures and Jami's work and cell number to the officer as evidence. The officer proceeded to state that battery charges could be brought against her, which would result in being escourted to one of the holding cells and possible jail time at the worst and probation/academic discipline at the least.
Secondly, I could opt for "campus charges," in which the department register the complaint through the school only, and the most likely results are that she is placed on "academic probation" (usually occurs when your grades are disturbingly low for a semester, you only have one more to bring them up or you're dismissed from the university). This is an reactionary academic probation, where if she's caught with alcohol in her dorm (she's 19) or gets an MIP, is at a party where drinking is involved, or engages in any other inappropriate action in her dorm or around campus, she will immediately be expelled from the university. She is Monday, Wednesday, Friday non-credit anger workshop course through the university. It's held at 8 PM and ends at 10 PM (and on a Friday, she'll absolutely loathe this).
I opted for the second option. A "campus charge" doesn't leave a permanent black mark on your record that is accessible by future employers, but does have certain consequences that won't ruin her future and/or result in jail/probation.

Shortly after the incident, after I clocked out, I walked to the clinic with one of my friends and I randomly blurt out "I should have chucked an ice tea bottle at her." Helena (my friend) gave me this awkward look and said "why an ice tea bottle specifically?" I started immediately changed the subject. :smile:

For some reason that makes perfect sense to me. I can't explain why, but I've seen this happen 100 times before.
The mindset of some people, it's like they were raised on some sort of forgiveness credit card. It's like they're punished, but two seconds later the adult feels bad for punishing the kid, so the kid's rewarded. This makes the adult feel loved again, but the kid gets off scott free with no real consequence. I've seen major reprocussions happen to kids with this mindset, they just don't get it, and they have the backing of adults who either aren't aware that the kids have no responsibility or they've learned to accept the berating/abuse the kids give them.
Have you ever heard a 12-year-old bitch out her parent? It's embarassing.

Thanks for the inquiry. I'm fine. It's just a bad experience. I got a call on my cell about an hour ago. Jami called me up to tell me "Diva" came in to see her about getting her job back. She didn't really think she was "terminated" because she felt I "had no real authority." Jami laid the verbal smackdown, stating that it was, in fact Jami who commissioned the termination and that student managers also may fire at will. I couldn't believe she'd literally come back after that incident with the delusion of expecting her job back.:shock:
How stupid is this bitch? She came in an hour late, threw around racial slurs, tore up your write up, punched you and still thought she wasn't really fired?
I SO wish you had done option 1.
Better question - who hired her in the first place????

I wouldn't assume that. It sounds like she's just "ghetto" enough to come back and try to do something. And if not with you then to someone else.

It comes from a long life of not having to deal with consequences. The fact that she's openly stated "I'll tell them you'll call me Nigger!" means that she was, in fact testing her boundries.
Everything about the exchange was her seeing how far she could go before she was fucking fired, and then trying to save herself by scaring you. I've fired about 30 people at AOL, and I'll tell you I've been told some horrible shit.
In one instance an employee claimed that I openly talked about having sex with a donkey on my weekend with three other supervisors (we were talking about Clerks 2.) And claimed that she was so emmotionally distraut she couldn't work for three days. I spent three days in HR prison dealing with that - hoping I wouldn't get fired. Only to find out that she claimed it happened on a day none of us were actually at work, five days prior to her not coming in. And then promptly never came back.
I've been threatened with violence, had my tires slashed, told I was going ot be sued, told that I was sexually assaulting someone, and more - but it boils down to you being shocked or you just saying "That may be the case, and you can take that up with whomever - but unfortunately we're going to have to part ways, because you've failed to live up to your obligation of coming to work on time."

I wish the people I work with would be fired for coming in late. Almost everyone that has to relieve me come sin as they please. SUre, it's usually only around ten minutes late most days, but it happens so consistently they should be reprimanded. But I used to call my boss about it every day and his solution was to send me a memo saying he was not to be contacted when my relief is running late.
