so these two dudes, James Gangwer and Tommy Dunbar, are suing APPLE for distributing Avril Lavigne's song "Girlfriend" saying it's a rip off of their song titled "I Wanna Be Your Boyfriend".

I just found the mp3 for the boyfriend song and holy shit, if they were suing Avril instead of Apple, then i bet they'd get some bucks out of RCA.

i have NO idea. just because apple has more money than avril? who knows.

but it should be made clear, they are suing apple INSTEAD of avril. there aren't 2 lawsuits going on. just one. and its crazy.

they are suing them for DISTRIBUTING plagiarized material. isn't this the same as suing every individual record store in the entire country, one at a time?

Yeah, it's a pretty standard thing. The songs are completely different and I seriously doubt they have a case.

Which is probably why they're suing Apple, because a big corporation would probably be more likely to just pass them off to avoid a court case.

They should just be happy their song is a lot better than hers and move on.

my favorite music plagiarism story has to be that of John Fogerty, who was actually sued for plagiarizing himself:

I didn't bother listening to the Boyfriend song, but I've heard Girlfriend-- it's standard rock/pop music, which means the boyfriend-guys don't stand a chance...

My rationale is, Sum 41 had that one song that was listenable ("We're All To Blame" or something similar to that title).
